Broaddus Council to Enforce Utility Cut-Off Policy

  

Meeting in regular session on Monday night, the Broaddus City Council voted to enforce the utility cut-off policy it passed in July 2009.

 

Letters will be sent to all customers with the March 1 billing, informing them bills become past due on the 15th of each month and if not paid by the 20th, city utilities will be shut off.  The city will also impose a $50 re-connect fee if the services were shut off due to non-payment.

 

Utility customers with an outstanding balance will have until March 15th to pay the full amount owed or they will be subject to having the utilities cut-off on March 20.

 

In other matters, the ongoing neighbor dispute between Fred Young and Linda Mutter once again surfaced at the meeting, this time focusing on the Mutter’s fence that allegedly protrudes onto city property in the alley.

 

Young has repeatedly requested the city to force the Mutter’s to remove the fence from city property, even though, according to a previous report from a City Councilperson, it is not causing any problems for the city, neighbors, or traffic.

 

When the fence was built by the Mutter’s last year, Young admitted to pointing out the property line to the Mutter’s.

 

Young previously told the Council he was not concerned about any other fence that encroached onto city property, only the Mutter’s.

 

The Council had previously been told that in order to determine the exact property lines in the alley, it was probable the entire city would have to be re-surveyed, possibly costing the city thousands of dollars.

 

Mayor Wayne Barth told the Council he had been in contact with an attorney and a Judge regarding the matter and was advised that the city should begin to save money for the costly survey and have the process performed when the city had the funds.

 

However, if Young files a complaint, it will force the city to expend funds for the one survey then save for the rest, according to Barth.  Previously the council has declined to perform the survey on the disputed property because of the high costs involved.

 

The Council voted to begin saving funds to survey all alley’s in the city.

 

A Community Development Block Grant from the Texas Department of Rural Affairs (TRDA) will allow the city to replace and increase the size of water distribution pipes on the north side of Highway 147.  According to City Operator Carl Pennington, the contracts could go out for bid within the next two to three months.  Piping is scheduled to be replaced on Sheffield Street, Caldwell Circle, Williams Street and FM 2558 north.  The council asked for patience and understanding when construction begins as some brief and temporary water outages in the area may be necessary.

 

Councilperson Misty Williams inquired about the status of action on the dilapidated buildings in town.

 

Barth told her that he was compiling a list of property owners and planned to bring the list and a proposed letter to the March Council meeting, informing the owners to either repair or demolish the structures.

 

The Broaddus City Council meets at 6:00PM the first Monday of each month and the public is invited to attend.
